About Child Custody in Texas

When conservatorship is agreed to or determined by the courts, there are a few options:

  • Joint managing conservatorship: in joint managing conservatorship, the rights and duties of the parents are split between two parties, usually the parents. One party will have primary possession of the child, which is what is commonly understood as having custody. In some cases, the right to make certain decisions will be awarded to one party exclusively, but this arrangement will still be known as joint managing conservatorship. In Texas, the presumption exists that this arrangement is in the best interest of the child, but this can be rebutted in court. For example, a showing of family violence removes this presumption.

  • Sole managing conservatorship: if one party successfully rebuts the presumption that joint managing conservatorship is in the best interest of the child, the court will award one party sole managing conservatorship. In this case, the managing conservator has the exclusive right to establish the child's primary residence, the right to consent to medical procedures on behalf of the child, the right to make decisions concerning the child's education, and other rights.

Child Possession and Access

Child visitation is more properly referred to as possession and access. There are standard guidelines for possession and access under Texas law, and they may apply to your case. However, the standard guidelines do not apply in all cases and may not be best for the child and other parties.
